Review of quarries sector to ensure compliance with Mining Act authorisations

The Resources Regulator Compliance Priorities for January to June 2022 includes a review of the quarrying sector across New South Wales to determine whether quarries are operating in accordance with the requirements of the Mining Act 1992.

The review is to determine whether the material extracted by individual quarry operations include scheduled minerals as defined in the Mining Regulation 2016.  Prospecting or mining of any scheduled mineral requires an approved Authorisation under the Mining Act 1992.

Accordingly, it is the Regulator’s position that any quarry within New South Wales that is extracting, or has extracted, any scheduled mineral without an approved authorisation is potentially operating in contravention of the objects of the Act.

To facilitate this review all quarry operators registered with the Regulator, excluding local councils, will be forwarded an email requiring a response by 31 March 2022 to specific questions to identify if scheduled minerals are being or have been extracted without authorisation.
